Chapter 19

I felt my fury rising as I walked up to the lectern. I glared at Rafe Johnson. He avoided my gaze. I took a breath. Angry as I was, it wouldn’t come off well with the jury.

“Detective Corning,” I started. “I just want to make a few things clear before we delve into the parts of your report Mr. Johnson conveniently forgot to ask you about.” So much for my plan to contain my rage.

“Objection!” Rafe was fuming. I could almost feel the heat coming off of him behind me. I refused to even turn to look at him.

“Counselor,” Judge Niedermayer said. “Let’s do better.”

I took another breath. “Detective Corning, regarding your analysis of Reed Karl’s cell phone … all you can do is track where the phone was within a specific range at a specific time, isn’t that right?”

“That’s correct. We can triangulate its location based on which cell towers it pings.”

“You know where the cell tower’s precise location is, not the phone’s. Correct?”

“That’s correct.”

“Anything else … even the conclusion that Mr. Karl’s phone was at home or at his office … that’s an inference based on where the tower is, not the phone.”

“Correct.”

“You can’t even be certain that Reed Karl was in possession of his phone during any of these readings you took, isn’t that right?”

“I’m not sure what you mean.”

“Oh, I think you are. But to be clear. Let’s take what you said about this pattern of movement during the last year. It’s a pattern of movement regarding the phone. You can’t say for sure whether Reed Karl was the one carrying the phone.”

“Well, no.”

“Okay. I’m just trying to make sure we all understand the parameters of your analysis.”

“Yes. I’m tracking the movement of the cell phone. That’s all.”

“Thank you. Now I’m curious. You testified about text exchanges between the defendant and Ms. Lewis. But that’s not the only data you were asked to analyze, right?”

“That was one aspect of my analysis, yes.”

“But you also were able to pull the camera rolls of both of those phones, right? Mr. Karl’s and Ms. Lewis’s.”

“Of course.”

“Great. But Mr. Johnson didn’t ask you about those photographs at all, did he?”

“No.”

“Right. So now I’d like to. Let’s talk about Mr. Karl’s cell phone first. I’d like to direct your attention to what’s been marked as Defense Exhibits Seven through Thirteen. Can you tell me what those are?”

Corning cleared his throat. “Yes. Those are photographs retrieved from Reed Karl’s camera roll on his phone.”

“And are you able to determine when those photographs were taken?”

“They’re time stamped and geotagged. Yes.”

“Geotagged?”

“The location where they were taken is part of the metadata we can look at.”

“All right. When were they taken and where were they taken?”

“All seven photographs were taken within three minutes of each other on May 29th of this year.”

“May 29th. So a little more than a week before Megan Lewis’s death.”

“That’s correct.”

“Your Honor,” I said. “I’d like to move for admission of Defense Exhibits Seven through Thirteen.”

“Objection, Your Honor, relevance.”

“Are you kidding?” I said.
